Terms of Service

MULTIPLE DAYS SHOOTING OR WORKING OVERSEAS BY DISCUSSION AND 3D AERIAL PHOTOGRAPHER SERVICES BY DISCUSSION.

Post Production
We have an excellent editing suite that can turn our raw footage into spectacular film. If you have any of your own footage that you want added into your film production then we can accommodate that too. Our editing package is a fixed rate of $150 per hour. Included video editor and Avid Suits.

Travel Expenses
In GTA area $50 for each job.
We will be happy to discuss any of the above with you in greater detail and think you will find us fair, reasonable and transparent.
We are happy to provide ANY quotes in writing once we have received a full brief from the Client and been able to discuss the requirements and expectations of the shoot.

Legalities
OnAir Canada seeks to observe privacy and copyright laws at all times. When operating on public land, highways or footpaths, local permissions may be required. We will endeavor to fulfill this aerial filming contract within the limitations of availability, equipment serviceability, weather restrictions, or other limiting factors. We cannot be held liable for failure to execute the task where these or similar restrictions emerge.

Weather
Drone operation is limited by wind strength. We can operate the drone between 15 – 20 MPH wind speeds at ground level. For any wind strength greater than these values, drone filming and photography is not possible.
The second factor is available light. The ideal operating times are between 6am – 5pm (summer) and 7am – 3pm (winter). A bright day without direct sunlight (thin cloud) is ideal, but sunlight is helpful for ‘modeling’ in some situations. We will advise on the circumstances and only operate to the best situation.
Time of day is the third factor – i.e. the direction of the light. The direction that a building faces (south / north / etc.) for example may dictate the best operating time – morning or afternoon. Again, our experienced operators will advise.

Availability, Booking & Deposit
Due to the nature of the weather in the GTA or any other city, and the nature of film shoots, we are very flexible when working with clients. We must have enough time to do pre-flight checks and ensure that the job can be undertaken safely, adhering to the rules & regulations of aerial filming and our operating license.
We are happy to pencil in potential jobs and dates for clients. However, actual bookings where deposits have been paid will always take priority. Naturally, if someone has a date penciled in we will go back to them with first refusal on their proposed date.
Due to the nature of the filming industry and working with a number of staff and freelancers, we do require our clients to commit when booking our services and time. Unless by special circumstances or if time doesn’t permit, we require 50% of the booking to be PAID IN ADVANCE.

Postponements & Cancellations
Aerial filming is naturally affected by the flying conditions. If due to weather (snow, rain, strong winds etc.) we are not able to shoot, we shall not charge the client if we can make alternative arrangements for the shoot to happen at another time. The 50% booking fee is simply transferred to another day when we can shoot.
If the shoot cannot be re-scheduled (which we usually know in advance of carrying out the job), we will discuss the cancellation policy and potential fees with the client and come to a fair and reasonable compromise.
If a job is cancelled due to other issues and simply not re-scheduled due to the client no longer requiring our services, the 50% deposit will not be refunded unless by a pre-agreement, and if additional costs have been incurred, they will also have to be met by the client.

Copyright & Usage
Unless a buyout of footage is specifically agreed and contracted, OnAir Canada retains the copyright of all filming content. The client purchasing the service of OnAir Canada will get full use of the material, however will not be able to sell the footage or allow 3rd party companies to use it without the agreement of OnAir Canada.
Naturally we are proud of our work and OnAir Canada actively promotes it, so we do reserve the right to use ANY of our footage for internal promotion, whether this be inclusion on our show reel or for PR purposes to promote OnAir Canada.

If you have any questions or issues with any the above, we would ask you to kindly speak to us in advance of commencement of filming. Thank you.
